Acclaimed Journalist Charged With ‘Anti-Semitism’

Mary Kostakidis appearing on CN Live!, where she has been a frequent guest. (CN Live!)

Special to Consortium News

For retweeting two tweets on X critical of Israel, famed Australian journalist Mary Kostakidis is facing charges of allegedly violating the country’s Racial Discrimination Act.

The complaint to the Australian Human Rights Commission from Alon Cassuto, the CEO of the Zionist Federation of Australia, highlights just two Kostakidis retweets from January this year, both of which contain a video of a speech by Hezbollah leader Hasan Nasrallah in which he allegedly called for the ethnic cleansing of Israel.

One of the retweets is from independent British journalist Richie Medhurst, who was arrested at Heathrow airport and held for nearly 24 hours under the U.K. Terrorism Act this month.  Medhurst is one of the most vocal critics of Israel’s war on Gaza. The other tweet is from a user named Censored Men.

The complaint was levelled under Section 18C(1) of the Racial Discrimination Act, which says:

“it is unlawful for a person to do an act, otherwise than in private, if:

 (a) the act is reasonably likely, in all the circumstances, to offend, insult, humiliate or intimidate another person or a group of people; and

 (b) the act is done because of the race, colour or national or ethnic origin of the other person or of some or all of the people in the group.”

Cassuto says Kostakidis should have made clear in her retweet of Nasrallah’s video that she did not agree or endorse it. He says Nasrallah was calling for the ethnic cleansing of Jews from Israel.

In the retweeted video, the Hezbollah leader says: “Here, you don’t have a future, and from the river to the sea, the land of Palestine is for the Palestinian people and for the Palestinian people only …”

Above that Nasrallah quote in the Censored Men retweet, Kostakidis wrote: “Israeli govt getting some of its own medicine. Israel has started something it can’t finish with this genocide.”

Cassuto told a press conference: “Those like Mary Kostakidis who have a status and a platform and a responsibility to lead, need to promote cohesion not division.”

Zionist Federation President Jeremy Leibler added: “Mary Kostakidis has misused her platform to spread ‘conspiracy theories’ to deny the use of sexual violence by Hamas on the 7th of October.”

However, Kostakidis cites in another retweet the conclusion of an exhaustive U.N. investigation that found no evidence of sexual violence by Hamas.

If the matter is not resolved at the Human Rights Commission the Zionist Federation could file civil charges in court. Australian Attorney-General Mark Dreyfus, however,  ‘is drafting hate speech laws to include criminal rather than civil penalties,” The Australian newspaper reported in an article about the Kostakidis case.

Kostakidis Responds

Kostakidis has denied the charges, tweeting that they amount to an “attempt to frame me as a rape and Holocaust denier.” She wrote on X:

“This because I have been sharing the reports of extremely highly regarded independent journalists who have written about the absence of credible evidence of the claims of ‘systemic, widespread rape’ by Hamas on Oct 7.

“To be clear, I have never said there was No Rape. It is something I could never say – it would be a nonsense for anyone to make such a definitive statement.”

An exemption under the Racial Discrimination Act says:

“18D Exemptions

Section 18C does not render unlawful anything said or done reasonably and in good faith: … (c) in making or publishing:

(i) a fair and accurate report of any event or matter of public interest; or

(ii) a fair comment on any event or matter of public interest if the comment is an expression of a genuine belief held by the person making the comment.”

Regarding the retweet of Nasrallah’s video, Kostakidis told The Sydney Morning Herald: “What are you saying, that we shouldn’t hear what the other side has to say? The point of that tweet was to say that Israel is inviting an escalation, it’s inviting retribution because it is conducting a genocide.”

Kostakidis’ lawyers tweeted today:

“XD Law are proud to defend Mary Kostakidis from the charges brought against her by the Zionist Federation of Australia under s18c of the Racial Discrimination Act … for sharing tweets about Gaza.

We filed her defence at the Human Rights Commission this week. Her instructions are clear – she will not be intimidated, she will not be gagged, she will not stop covering international events as she has her entire career. And that includes Israel, warts and all.

‘The Australian Zionist Federation is weaponising Australian law in an attempt to curb criticism of Israel for its acts of genocide. I won’t be intimidated by them in the face of the slaughter of tens of thousands of children, hundreds of doctors, nurses, journalists and other civilians.’” — MK

The statement goes on to say:

“Since the conflict in Gaza began Mary has been a force on Social Media giving live updates, sharing reports on the devastation there and accounts of ordinary people trying to survive it. And she is still at it.

Over the past 40 years Mary, the face of SBS news for 20 of them, has been a central figure in building a tolerant multicultural Australia. It is that reputation that her opponents are seeking to tear down because she has dared criticise Israel.

‘Imagine a situation where we can criticise our own government’s policies and actions but not those of another state, depending on how powerful and cashed up their lobby groups are. They will continue to defame me in the press but please remember this is happening to journalists, academics and others all over the western world. We are on the right side of history and international law. I have no trouble standing up to bullies.’ — MK

Mary first heard that the complaint had been filed through an astonishing press conference conducted by the CEO of the Zionist Federation and a partner at the law firm bringing the action. Side by side they attacked her, her reputation and her life’s work without restraint.

Clearly her opponents have an eye to score public hits upon Mary irrespective of the commission proceedings. We have her covered in the courts.

There is no fundraiser yet but if you want to help defend Mary now do it in the public spaces where she is under attack. Defend free speech for all Australians. Defend social media. Defend Mary Kostakidis.”

Sawsan Madina, a former Head of SBS Television, wrote:

“The attempt to silence Mary Kostakidis has alarming implications for all of us. If a complaint can be lodged against a high profile journalist like Kostakidis, for publishing newsworthy information, what will this do to freedom of the press? How many journalists will self-censor? Will we be treated as children who are only allowed to read material deemed acceptable to the government or powerful vested interests?”

The BRICS weigh in on Palestine

The gravity around the newly-enlarged BRICS constellation is drawing in Arab, Muslim, and Global South adherents to the influential group's message on international law, Palestine, and halting forever wars.

NOTE: This article first ran on June 15, 2024

MOSCOW - Something of extraordinary magnitude happened in Moscow on 23 May. Bahrain's King Hamad bin Isa Al Khalifa personally asked Russian President Vladimir Putin to help organize a peace conference on Palestine, at which Russia would be the first non-Arab nation invited.

Al-Khalifa and Putin had two rounds of discussions - one of them closed - during which the main focus was always Palestine. The Bahraini monarch noted that in a rare show of unity, the Arab world had finally come together in agreement to end the war in Gaza. It was implied that Russia was subsequently chosen as the most reliable mediator to end the brutal conflict.

Bahrain – and the Arab League – recognize that the Russian position centers around what Putin had previously defined as the “UN formula”: an independent Palestinian state with its capital in East Jerusalem.

That happens to be the position of the BRICS-10 nations and virtually the whole Global Majority. Crucially, it is also the common position of China and the Arab world, reaffirmed in Beijing only one week after the Russia-Bahrain meeting.

The problem is how to implement the “formula” when the US hegemon, Israel's unconditional ally, has a virtual stranglehold on the United Nations.

By 2020, as Tel Aviv was openly announcing the inevitable annexation of the West Bank, the Abraham Accords were smashing a major Arab taboo on openly supporting Israel, via the normalization agreements signed in Washington DC by Bahrain, the UAE, Morocco, and Sudan.

Nine months ago, Palestine was virtually isolated, and destined to extinction via quiet Israeli policies to incrementally force expulsion. But never underestimate the power of a genocide committed in broad daylight, on video. Today, the Russia-China strategic partnership, BRICS, and the Global Majority have been mobilized to enshrine Palestine as a sovereign state – faithful to the recent super-majority UN General Assembly vote to accept Palestine as a UN member.

It will be a long, winding, and thorny road that has the potential to split the world in two.

Lavrov lays it all out

The St. Petersburg forum last week offered three crucial messages to the Global Majority, focused around BRICS. The crux of the sessions may have been geoeconomics, but a now-unavoidable message of support to Palestine crept into the sidelines.

After a panel ostensibly debating the supply and demand of oil and gas, and which touched upon the principled role of Yemen in the Red Sea directed against the Gaza genocide, support for Palestine, amidst friendly smiles (but off the record), was emphatic from everyone - from OPEC secretary-general Haitham al-Ghais to the UAE’s Minister of Energy Suhail Mohamed al-Mazrouei.

Same on a Russia-Oman  panel, coming from Minister of Commerce Qais bin Mohammed bin Moosa al-Yousef.

Earlier this week, the Palestine tragedy was addressed in detail – on points 34 and 35 – in the joint statement of the BRICS 10 Ministers of Foreign Affairs, who sat at the same table for the first time in Nizhny Novgorod, preparing for the extremely important annual BRICS summit next October in Kazan, under the Russian presidency. Three very important points were made there:

First, the Ministers “reaffirmed their rejection of any attempt aiming at forcefully displacing, expelling or transferring the Palestinian people from their land.” Second, they collectively “expressed serious concern at Israel’s continued blatant disregard of international law, the UN Charter, UN resolutions and Court orders.” And third, the ten foreign ministers:

“Reaffirmed their support for Palestine’s full membership in the United Nations and reiterated their unwavering commitment to the vision of the two-state solution based on international law including relevant UNSC and UNGA resolutions and the Arab Peace Initiative that includes the establishment of a sovereign, independent and viable State of Palestine in line with internationally recognized borders of June 1967 with East Jerusalem as its capital living side by side in peace and security with Israel.”

This is BRICS speaking with one voice – including, crucially, representatives of major Muslim-majority states: Iran, Saudi Arabia, the UAE. and Egypt.

Then Russian Foreign Minister Sergey Lavrov, at an expanded BRICS session defined as BRICS+/BRICS Outreach, offered extra, important, context.

“We held an intra-Palestinian meeting in Moscow. We did this repeatedly. The last time it was held in late February and early March of this year, all Palestinian factions, including Hamas and Fatah, were present. For the first time, an event of this kind ended with the adoption of a joint statement in which everyone, including Hamas, expressed their readiness to unite the Palestinian ranks on the basis of the platform of the Palestine Liberation Organization. Previously, it was not possible to achieve this.”

Lavrov explained why, for Russia, it is essential to restore Palestinian unity:

“Only a united Palestine can be a partner in negotiations aimed at achieving the maximum desired outcome. As long as the Palestinians are divided, this is unlikely to work. Now, without any Palestinians, they are beginning to think about what to do with the Gaza Strip next: either to establish some kind of protectorate of Arab countries, or to introduce some kind of peacekeeping force, or to artificially declare that these will be territories governed by the Palestinian National Authority. These are all initiatives that are imposed by external players.”

And that brings us to the kernel of the Russian position: “The most important component of our long-term policy in this area will be to support the movement for the creation of a Palestinian state in full compliance with UN resolutions.”

How to respond “symmetrically”

All of the above sums up the carefully calibrated, official Russian position. Moscow abhors Israel's non-stop, irrational escalation while ceasefire proposals are on hand galore. At the same time, it won’t take sides – either with Hamas or with Yemen's Ansarallah. It is a consensus diplomats and Russia analysts routinely express: Russia will not get into a war thousands of kilometers away when it is fighting a US/NATO existential threat right at its western border.

West Asia, predictably, features in the favorite scenario: advanced strike weapons deployed in Syria, described as “Syrian weapons” to mirror the west's “Ukrainian weapons” subterfuge. These would supplement arms already deployed at Russia's Khmeimim and Tartus bases – covering the Eastern Mediterranean, Lebanon, Israel, and US bases in Jordan, occupied Syria and occupied Iraq - and would be operated by Russian personnel, much as US/NATO personnel operate "Ukrainian" weapons.

A BRICS thorn

Now we come to the thorn in the BRICS flower arrangement - Saudi Arabia.

A discombobulated White House and US Deep State seem to have found a formula to wean Riyadh away from its new role as strong BRICS player: a landmark defense treaty, dubbed the Strategic Alliance Agreement, in the wings awaiting Riyadh's formalization of relations with Tel Aviv.

The Strategic Alliance Agreement would need to get a two-thirds majority vote in the US Senate. Yet insistence on “normalization with Israel” may well kill the deal, as Saudi Crown Prince Mohammad bin Salman (MbS) now has options to carefully consider, not only regarding the Gaza tragedy, but over his new BRICS alliances.

Moreover, a Saudi-US military alliance is totally incompatible with Riyadh becoming an influential member of BRICS. Chessboard moves are instead pointing to sooner or later a possible Global Majority military alliance to counterpunch the escalating US/NATO war -  Hybrid and otherwise – against the dawning of a multinodal, polycentric, and in Putin’s terminology in St. Peterburg, “harmonic” multipolar world.

Add to it the expiration earlier this week of the US-Saudi agreement signed 50 years ago to establish the petrodollar, essentially in exchange for US military protection.

Already last year Riyadh made it clear the agreement would not be renewed when it clinched a deal with China based on energy trade using the petroyuan.

So in theory we are advancing further on down the road towards the demise of the petrodollar, coupled with the expansion of the digital yuan. The Central Bank of Saudi Arabia is now a “full participant” of Project mBridge, which unites the BIS Innovation Hub, the Central Bank of Thailand, the Central Bank of the UAE, the People's Bank of China, and the Hong Kong Monetary Authority.

Essentially, mBridge is a multi-Central Bank digital currency (CBDC) platform shared among Central Banks and commercial banks, and enabling instant cross-border payments and settlement. Thailand, for instance, is buying oil from the UAE using mBridge.

There are no less than 26 mBridge observers – quite a mixed bag, including the China-led Asia Infrastructure Investment Bank (AIIB), the European Central Bank, the IMF, and the World Bank.

As Saudi Arabia joins mBridge, Saudi Aramco - after opening itself to foreign investors with a huge IPO - has just ceded an extra 0.64 percent of its capital, with 60 percent of the buyers American. Aramco is a humongous fountain of dividends for shareholders: this year, that will amount to a whopping $141 billion.

Guess who are the top new investors? The Big Three – Vanguard, BlackRock, and State Street - now all wallowing in Saudi oil.

Arabs, CENTCOM, and Israel: in bed together?

And now for the ultimate complicating factor.

On Monday, military officers from Bahrain, Egypt, Saudi Arabia, the UAE, and Jordan – which includes three BRICS members and Russia-friendly Bahrain - met with Herzi Halevi, the IDF’s Chief of General Staff to discuss…defense cooperation.

The meeting was facilitated by none other than the US CENTCOM. Although as low-profile as it gets, the meeting still leaked, given the juxtaposition of the Gaza genocide alongside a meeting of top Arab leaders sitting with the Arab world's worst enemies.

A post-modern epigone of the cynics dwelling in the Agora in Ancient Greece would remark that with CENTCOM Arab “friends” like these – three of them BRICS members - Palestine does not need enemies.

Meanwhile, the tragedy persists on so many levels. As Chinese high school students all across the civilization-state show their support for Palestineafter taking their university entrance exams, the US-Israel axis homogenizes terrorism, linked to the debacle of Project Ukraine, coupled with the non-stop killing of Palestinians.

Everything is being sucked into the black hole of terrorism – complete with NATO now openly re-arming the neonazi Azov Battalion, and Kiev targeting civilians in Belgorod with drones and scattering mines in parks where kids play.

All the components of the Hegemon-fed Terror Foreign Legion are coming together, in lockstep with Israel, which is essentially ISIS with nuclear weapons. But for all their lofty ideals and sacred belief in the UN, the BRICS still have not come up with a solid, practical strategy to fight the horror.

“Christian” Zionism

Massive and systematic suppression of truth has long shielded the state of Israel from scrutiny of its crimes and proper punishment.

Texas evangelist John Hagee, founder of Christians United for Israel, is probably one of the most toxic fanatics preaching Christian Zionism, thereby prolonging the crimes of Israel.

Fundamentalist Evangelicals, under the influence of ultra-right political activists, generally believe, and teach, that Islam is a dangerous religion that leads to terrorism. Trumpistas used this narrative to keep the Muslims down and garner votes.

These same Evangelicals also generally believe in a doctrine known as “Christian” Zionism, which teaches that the Second Coming of Christ is inextricably linked to the state of Israel and that Christians must support Israel to hasten Christ’s return to earth. Roman Catholicism has long tried to separate itself from “Christian” Zionism but there are undercurrents in Catholic thought that seem destined to bring that Church closer to the Evangelical way of thinking.

Thus, today’s Christianity is at least open to this doctrine while most Evangelicals wholeheartedly accept it.

In keeping with this, US Christianity has, since WW II, been a solid proponent of the US government’s war machine. During the many wars waged by the US since then, pastors have stood before their congregations on Sunday mornings and prayed out loud “Lord, protect our men in uniform.”

Yet, very few pastors have ever thought to ask the Lord to protect the innocent against US bombs and bullets.

To pray for the safety of the Koreans, the Vietnamese, the Iraqis, the Libyans, the Syrians, etc, would have seemed blasphemous to most church goers, who have long unwittingly accepted their role as defenders of US hegemony. After all, throughout the 50s and 60s, Christians and even many of the less religious in America have taken to heart the mission of “stopping the spread of godless communism.” Even when the word “godless” is not expressly mentioned, its meaning is generally tacitly understood. US Christians also subconsciously see themselves as an embodiment of ancient Israel, the chosen people. Since they also identify modern Israel with ancient Israel, there is a tacit understanding that Israel and the US are two sides of the same sacred coin or that Israel is just really part of the US. Thus, AIPAC, the Israel lobby, is exempted from the obligation to register as a foreign lobby even though it certainly qualifies as one.

Thus, loathe as we are to admit it, religion is a key motivator behind US wars, and the “men in uniform” – or since the surge in feminist influence, “men and women in uniform,” have been seen as emissaries of God sent to save the world from un-American, and hence, ungodly, influences — though the US has lost almost all of these wars, just as the Church lost the Crusades.

Indeed the churches are de facto the most effective propaganda arm of the Pentagon, whose weapons of mass destruction have killed millions of mostly civilians, many times more than Muslim terrorists have, who have no air force.

The Bible “scholars” behind these religious Zionist teachings, while differing amongst themselves in secondary details, agree in essence that the modern state of Israel is the embodiment of the resurrected dry bones mentioned in Ezekiel 37. They also agree – with zero scripture to support them – that the leaders of Israel are led by God in their military decisions, just as the leaders of the Israelites once enjoyed divine guidance when marching to battle. The fact that until 2006, modern Israel had never lost a war was attributed by many Evangelicals to divine intervention – when in fact, it was thanks to US weapons and money and to the weakening of Israel’s Arab neighbours thanks to heavy-handed US foreign policy that suppresses states that refuse to recognize Israel.

Thanks to the unconditional support of America’s millions of fundamentalists, the US government can provide military aid to the Israelis and can ignore all of Israel’s human rights abuses, now more and more openly discussed by groups like Amnesty International and Human Rights Watch, and under investigation by the ICC .

Indeed, based on the above-described religious reasoning, since 1948, the US has vetoed all UN resolutions condemning Israel’s crimes, as documented here and here.

So how is it possible for US “Christians” to ignore Israel’s endless string of human rights abuses when they directly contravene God’s commandments – including the Torah admonition to love they neighbour as thyself.

Very simply, by smugly reminding themselves that the accusers are “unsaved” or “lost” and could not possibly have the spiritual discernment to see that Israel’s every move is the implementation of a divine directive. US Evangelicals pride themselves in being privy to this divinely transmitted knowledge about modern “Israel”, which has, however, no basis in scripture, reason, logic or fact and tramples on Christ’s teachings.

And this is the tragedy not of Christianity itself, but of an interpretation of the scriptures that is not at all in keeping with Christ’s teachings.

Nonetheless, despite the Evangelical insistence that “Christian” Zionism is based on scripture, the texts from which their teachings are derived are cherry-picked completely out of context from various and sundry unrelated passages scattered all over the Old and New Testaments and often contradictory to the Zionist doctrine itself.

Ezekiel's prophecy of a dead Israel that is miraculously resurrected like bones of a long dead cadaver, that would re-assemble themselves and acquire a suit of flesh, tendons and skin, prophesies that the resurrected Israel – whose members have been, for example, led into captivity and then liberated and returned to their homeland, would be obedient to God’s decrees (Ezekiel 37:24).

And yet, Evangelical fundamentalists are the first to admit that today’s secular Israel is not in any way obedient to God’s decrees, at least in their family-friendly anti-abortion and pro-family views. In fact, if we consider the Torah commandment to “love your neighbour as yourself” (Leviticus 19:18), there simply is no way we can honestly see Ezekiel’s prophecy as referring to modern Israel, which in 2021, slaughtered 68 children in an air raid, and many more before that. I refer the reader to the historical documentary Born in Gaza, in which a young Palestinian testifies that he, as a child, and his pals, while walking along a beach, were specifically targeted by an Israeli war-plane that swooped down and fired at them, killing several children, then turned around, came back and fired at the survivors, killing more of them. Only a handful survived. This was more than collateral damage of a war. If we want to be honest, it was genocide.

It is reminiscent of the infamous USS Liberty incident.

Ezekiel himself was exiled by the Babylonian conquerors, so it is logical to assume that he was referring in his prophecy to the return of himself and his fellow expats to Judea, which happened in 587-6 BC. The more devout Israelites that returned home at that time were more likely than today’s secular Israel to have answered Ezekiel’s description of the dry-bones Israel, which was in fact resurrected when Persian king Cyrus, who had inherited the Judean captives from Babylon in the conquest of that country, liberated them.

So why do so many Evangelicals cling so devoutly to a Zionist doctrine that hangs from such a tenuous web of cherry-picked scripture?

The doctrine was first popularized by Cyrus Scofield in his highly popular Reference Bible, which was full of annotations, many of which were products of his imagination. For example, in his annotations on Ezekiel 38, he birthed the popular myth that Russia would attack Israel in the latter days, thereby contributing greatly to the already thriving Russophobia prevailing in the US and Europe.

Scofield, apparently himself a Russophobe, used the flimsiest of excuses to identify the prophesied attacker, which Ezekiel named Gog and Magog, as Russia. He said the names Meschech and Tubal, appearing in the passage, were a “clear mark of identification” because they sounded like Moscow and Tubolsk. The problem is that Moscow doesn’t sound enough like Meshech and Tubal doesn’t sound enough like Tubolsk to make this crystal “clear,” and besides, Tubolsk was never an important enough city to use as an identifier for Russia, which, of course, did not yet exist in the BC. Scofield was clearly just making it up. And yet, when I was growing up in the Bible belt, local fundamentalists declared that the Scofield Bible was inspired by God.

Further, Scofield wrote that Gog and the leader Magog were places located in Russia.

Not even close, as it turns out. According to Ezekiel, Gog is a place and Magog is a leader of it. And in fact, Assyrian court records identify Gog as a place in what is now Turkey, not Russia.

Another reason the resourceful Scofield figured Russia must be the culprit was that, in his words, “Russia and the northern powers [none specified] have been the latest persecutors of dispersed Israel.” Perhaps, at least in 1909 when the Scofield Bible was first published, but then Scofield had never heard of the Third Reich that was yet to come. Otherwise he’d have been obliged to pick Hitler for the role.

This haphazard guesswork approach to scriptural exegesis makes Scofield’s conclusions about the modern Israel all the more questionable to un-indoctrinated people.

The assignment of Russia to the Gog and Magog prophecy was clearly just a contrivance not different from Scofield’s imaginative tale of Israel, which served the Zionists’ purpose at the UN in 1948, when Israel became a nation after European Jewish terrorists ethnically cleansed Palestine by slaughtering dozens of men, women and children in places like Deir Yassin, and after the US, imbued with “Christian” Zionist lore, pressured other nations to vote for the statehood of an entity whose inhabitants were almost all Europeans who had never seen the Middle East before the Zionist mass exodus and settlement of land once home to thousands of Palestinians.

Israel has been slaughtering Palestinians ever since, with America’s tacit blessing.

To understand the terroristic founding of Israel it is necessary, as a bare minimum, to understand the history chronicled in the documentary Al-nakba. (See below)
